15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAYTUKS NETWORK, ITS OPERATORS, EDITORS, CONTRIBUTORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATION, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF FAYTUKS NETWORK FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID TO FAYTUKS NETWORK IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to defend, indemnify, and hold harmless Faytuks Network, its operators, editors, contributors, affiliates, licensors, service providers, and representatives from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- your use of the site;
- your comments, submissions, or other content;
- your violation of these Terms;
- your violation of any law or third-party right.
17. Dispute Resolution and Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site shall first be submitted to informal resolution by contacting faytuksnetwork@gmail.com. If the dispute is not resolved within 30 days, it shall be resolved by binding arbitration on an individual basis.
Unless otherwise required by applicable law, the arbitration shall be administered under commercially reasonable arbitration rules selected by Faytuks Network, and may be conducted remotely, by written submissions, or at a location designated by Faytuks Network.
The complaining party shall be responsible for initiating and paying filing and administrative costs to the maximum extent permitted by applicable law, subject to any fee reallocation required by the arbitrator or applicable law.
You and Faytuks Network waive any right to a jury trial and waive any right to participate in a class action, class arbitration, collective action, private attorney general action, or other representative proceeding.
Notwithstanding the foregoing, either party may bring an individual claim in small claims court where eligible, and Faytuks Network may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, systems, or other rights.
18. Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING.
19. Governing Framework
Because Faytuks Network operates internationally, these Terms are intended to be interpreted to the maximum extent permitted by applicable United States law.
20. Termination
We may suspend or terminate your access to the site, block comments, remove content, or take technical or legal measures at any time, with or without notice, for any reason, including suspected violations of these Terms.
Sections that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and class action waiver.
